Informativa e richiesta di consenso al trattamento dei dati personali ai sensi dell'art. 13 del D.Lgs. 196/2003

Pursuant to Art. 13 of Law 196/2003 - Code for the protection of personal data, Cogest Italia S.r.l. provides some information on the utilisation of the personal data supplied to us by existing or future clients. The term “personal data” is defined as all the information relating to an identified or identifiable data that has in some way been recorded..

1. Method of collection
The personal data in the possession of Cogest Italia S.r.l. have been collected directly from clients at the time of the request to furnish goods or services.

2. Objectives
The personal data are processed as part of the normal business activities of Cogest Italia S.r.l. for the following purposes:
1. Purposes strictly linked to and instrumental for the management of the relationship with the client
2. Purposes deriving from legal obligations, regulations, EU directives, instructions imparted by legal authorities and supervisory and control organisations
3. Purposes involving the protection of the legitimate interests of Cogest Italia S.r.l. before the courts or in its dealings with legally constituted authorities.

3. Method of processing
In relation to the purposes listed above, personal data are processed manually, by computer and telematically, using logics strictly correlated to said purposes and always in a way that ensures data security and confidentiality.

4. Communication
Within Cogest Italia S.r.l. only authorised persons belonging to head office and peripheral offices can have access to your data. Your data may be transmitted to other members of the Group, including outside Italy, in the latter case using methods that guarantee an equal level of protection in processing.
To pursue the objectives indicated above, Cogest Italia S.r.l. may need to communicate your data to external parties or organisations, always on condition that the latter agree to use the personal data solely to carry out the tasks assigned to them in accordance with the instructions of Cogest Italia S.r.l.
These parties and organisations belong to the following categories:
• persons or structures that perform technical or support activities for Cogest Italia S.r.l., such as for example: software development/maintenance
• legal and tax consultants, notaries, experts
• parties that provide banking, financial, insurance services, including those that intervene in the management of payment systems
• parties that investigate risks of illegal activities, financial fraud with the aim of preventing the risk of insolvency and credit recovery companies
• parties that carry out audits and certification of the business activities set up by Cogest Italia S.r.l., including in the interests of the clients

5. Obligatory communication
Cogest Italia S.r.l. does not require your consent for the processing and communication of the data regarding the purpose specified under 1) since these are required for the performance of contractual and precontractual obligations, under 2) because these are legally obligatory and under 3) because these are
necessary for protecting your rights.

Rights of the party concerned
The rights of the party concerned in relation to the processing of his/her personal data are indicated in Art.7 of Law 196/03 and listed below.

1. The right to obtain confirmation of the existence or non-existence of his/her personal data, even if not yet recorded, and their communication in an intelligible form.

2. The right to know:
a. the origin of the personal data
b. the purposes and method of processing
c. the logic applied in the case of processing with the aid of electronic instruments
d. the identifying details of the proprietor, the managers and the representative appointed pursuant to Art. 5, clause 2
e. the parties or categories of parties to which the data may be communicated or which can learn about same as the designated representative within the country, or as a manager or employee

3. The party concerned has the right:
a. to have the data updated or rectified, or if he/she wishes, to have additional data inserted
b. to cancel, transform into anonymous form or block data processed in breach of the law, including data that do not need to be preserved in relation to the purposes for which they were collected or subsequently processed
c. to be given proof that the operations referred to under letters a) and b), including with regard to their content, have been brought to the knowledge of those to whom they were communicated or circulated, except when this proves to be impossible or involves the use of means that are manifestly disproportionate with respect to the right that is protected

4. The party concerned has the right to object, totally or partially:
a. for legitimate reasons, to the processing of his/her personal data even if pertinent for the purpose for which they were collected
b. to the processing of his/her personal data for the purpose of sending advertising material or direct sales or for carrying out market surveys or marketing communications
